Website and engagement terms
Scope and proposals
Deliverables, milestones, review rounds, dependencies, owners and handover expectations are defined in the written engagement document. Work outside that scope may require a change request, revised fee or revised timing.
Pricing and payment
Published prices are starting points or typical entry levels, not binding quotations. Final fees depend on scope, complexity, production, integrations, markets and required ownership. Media spend, software, data services, licences, travel and specialist third-party production may be charged separately when relevant. Payment timing, deposits and invoicing are defined in the accepted proposal or agreement.
Scheduling, delays and cancellation
Project timing depends on agreed access, approvals, feedback and third-party dependencies. Delays caused by missing information or approvals may move delivery dates. Rescheduling, cancellation, pause fees or non-refundable work already completed are handled according to the project-specific agreement.
Client responsibilities
The client is responsible for providing accurate information, authorised access, timely decisions, necessary approvals and permission to use materials supplied for the project. The client remains responsible for the legality and accuracy of its own products, claims, offers and business operations.
Results and performance
Digital work can improve the probability and quality of commercial outcomes, but no specific revenue, ranking, lead volume, conversion rate or advertising result is guaranteed unless a written agreement explicitly states otherwise. Performance can be affected by market conditions, competition, media costs, sales execution, platform changes and factors outside James Digital's control.
Portfolio and evidence
Public project links and case studies are presented with contribution and evidence notes. Company-wide or career outcomes are not automatically attributed to one project unless the relevant page states the evidence basis.
Intellectual property
Ownership, licences, source files, reusable components, third-party assets and handover rights are defined per engagement. Pre-existing tools, methods, libraries and know-how remain with their existing owner unless the written agreement states otherwise. Third-party trademarks and project assets remain the property of their respective owners.
Confidentiality
Non-public business information received for a project should be treated as confidential and used only for the engagement, subject to the written agreement and any disclosure required by law. Public case-study use of confidential information or non-public results requires an appropriate basis or permission.
Third-party platforms
Websites, advertising platforms, analytics, CRM systems, hosting, software and APIs are operated by third parties. Their availability, policy changes, pricing, outages and account decisions are outside James Digital's control. Where a third-party service is required, the client may need to accept that provider's terms directly.
Liability
Any project-specific limitation of liability is defined in the written engagement agreement. Nothing on this website is intended to exclude rights or liabilities that cannot legally be excluded.
Governing law and disputes
The governing law, dispute process and forum for paid work are specified in the relevant proposal or agreement. Mandatory legal rights that apply to either party are not intended to be overridden by this website notice.
Changes to these terms
These website terms may be updated when the service model, website functionality or commercial process changes. The page displays its latest modification date in the site metadata.
